In lieu of filing an answer to the Complaint, Defendants pursued a Motion for Summary Disposition based upon a settlement agreement previously executed in the PIP litigation barring Claimant’s past, present, and future claims that were not identified as excluded from the settlement agreement. Judge Burke granted the motion without oral argument. While Judge Burke’s Opinion and Order is quite concise, the ultimate result was still achieved, dismissal, with prejudice, in lieu of answering Plaintiff’s Complaint.
