Following the Michigan Supreme Court’s recent opinion in Kandil-El Sayed v F & E Oil, Inc, 162907 & 163430, 2023 WL 4845611 (Mich. July 28, 2023), Mr. Grimske successfully defended an apartment complex in a 5-day premises liability trial where Plaintiff tenant sustained significant injuries due to a slip and fall on ice. The jury, in applying the new framework as outlined in Kandil-El Sayed, found Plaintiff to be 70% at fault for causing his injuries. Despite a pre-trial demand of $810,000.00, and a trial demand of $4,680,000.00, the jury’s verdict was $28,127.05.
