Open and Obvious v. Inadequate Lighting: Singerman’s Encore?

Darkness alone does not create a genuine issue of material fact as to whether a condition is discoverable upon casual inspection. Darkness itself is open and obvious. Courts must apply the objective standard to the circumstances presented to the plaintiff at the time of the injury.
