Plaintiff filed this lawsuit after she was prosecuted for stealing a pair of eyeglasses from Defendant’s place of business. Plaintiff alleges a false statement was submitted to the police by Defendant and Plaintiff was wrongfully prosecuted based upon the false statement. Counsel successfully argued that Plaintiff’s payment of restitution barred her claim for malicious prosecution, the statement to the police was privileged and that Defendants acted reasonably in calling the authorities in reporting the crime. Ultimately, the Court was persuaded that Plaintiff had no evidence to support her claim.
