Environmental and Toxic Tort

In the late 1960s, it was the mercury pollution cases.  In the early and mid-1970s, it was the PCB scare and Agent Orange.  In the late 1970s and throughout the 1980s and 1990s, asbestos litigation, leaking underground storage tanks, and the cleanup of toxic waste sites were the focus of litigation. Today, talcum powder, popcorn lung, mold, lead paint, ozone, silicone implants, silica, metal working fluids, and welding rods have been added to the list.  In each instance, Secrest Wardle’s Environmental Group has had a principal role in defending the litigation.  At the start of the 21st century, many of these issues continue to demand the attention and resources of our clients.

Environmental cases often involve numerous parties, complex legal and scientific issues and thousands of documents.  Our Environmental Practice Group is uniquely equipped with the litigation and document management systems required to meet this challenge.  The Environmental Practice Group has defended multi-million dollar class actions and mass litigation actions involving PCB, asbestos, urea-formaldehyde foam insulation, and silicone gel-filled implants.  We served as National Trial Counsel and Mid-West Regional Counsel in over 5,000 suits in 12 states for a major asbestos manufacturer.  As a result of our commitment, Secrest Wardle was selected as one of the best environmental firms in the nation by a survey of 400 in-house lawyers as reported in an American Lawyer/Corporate Counsel Magazine survey.
